hadith 225

Hadith.5193 - Ibn Faddal narrated from Ibn Bukayr from Abu Abdullah (as) regarding a man who falls upon another man and kills him, and the one on top dies. Imam (as) said

"There is no liability upon the one below."

5193 - وَ رَوَى اِبْنُ فَضَّالٍ عَنِ اِبْنِ بُكَيْرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : فِي اَلرَّجُلِ يَقَعُ عَلَى اَلرَّجُلِ فَيَقْتُلُهُ فَمَاتَ اَلْأَعْلَى قَالَ

"لاَ شَيْءَ عَلَى اَلْأَسْفَلِ".

Hadith.5055 - Ibn Mahbub narrated from Abdullah ibn Bukayr from Anbasah ibn MuṣAb who said

I asked Abu Abdullah (as), "If my bondwoman commits adultery, should I administer the prescribed punishment on her?" Imam (as) replied: "Yes, but let it be done in secrecy, for I fear the ruler's authority upon you."

5055 - وَ رَوَى اِبْنُ مَحْبُوبٍ عَنْ عَبْدِ اَللَّهِ بْنِ بُكَيْرٍ عَنْ عَنْبَسَةَ بْنِ مُصْعَبٍ قَالَ

قُلْتُ لِأَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ إِنْ زَنَتْ جَارِيَةٌ لِي أَحُدُّهَا قَالَ "نَعَمْ وَ لْيَكُنْ ذَلِكَ فِي سِرٍّ فَإِنِّي أَخَافُ عَلَيْكَ اَلسُّلْطَانَ".

6. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah and Ali ibn Ribat from ‘Abd Allah ibn Bukayr from ‘Ubayd ibn Zurarah who has narrated the following

“Abu ‘Abd Allah (a.s.), has said that brothers from mother’s side do not receive any share from the wergild.’”

6- حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ عَبْدِ اللهِ بْنِ جَبَلَةَ وَعَلِيِّ بْنِ رِبَاطٍ عَنْ عَبْدِ اللهِ بْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ

لا يَرِثُ الإخْوَةُ مِنَ الأمِّ مِنَ الدِّيَةِ شَيْئاً.

hadith 1164

22-9 (The compiler of the book narrated) that his father - may God be pleased with him - narrated that Sa’ed ibn Abdullah quoted Ahmad ibn Aba Abdullah al-Barqy, on the authority of Al-Hassan ibn Ali ibn Faz’zal, on the authority of Abdullah ibn Bakir, on the authority of Abdul Ali ibn A’ayn, on the authority of Aba Abdullah as-Sadiq (MGB), “It is recorded in Ali’s (MGB) book that the

blood money for a hunting dog is forty Dirhams.”

22-9 حدثنا أبي رضي الله عنه قال: حدثنا سعد بن عبد الله قال: حدثنا أحمد ابن أبي عبد الله البرقي، عن الحسن بن علي بن فضال، عن عبد الله بن بكير، عن عبدالاعلى ابن أعين، عن أبي عبد الله عليه السلام قال

في كتاب علي عليه السلام دية كلب الصيد أربعون درهما

Hadith.5043 - In the narration of Al-Hasan ibn Mahbub from Abu Ayyub, who heard Ibn Bukayr narrating from one of the Imams (peace be upon them), it is reported

"Whoever commits fornication with a close relative (one prohibited in marriage) until intercourse occurs, he is to be struck with the sword in a blow that takes from him whatever it takes. And if she consented to him, she is to be struck with the sword in a blow that takes from her whatever it takes." It was asked: "And who carries out the punishment upon them when they have no accuser?" Imam (as) replied: "That is up to the Imam when the case is presented to him."

5043 - وَ رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ قَالَ

سَمِعْتُ اِبْنَ بُكَيْرٍ يَرْوِي عَنْ أَحَدِهِمَا عَلَيْهِمَا اَلسَّلاَمُ قَالَ: "مَنْ زَنَى بِذَاتِ مَحْرَمٍ حَتَّى يُوَاقِعَهَا ضُرِبَ ضَرْبَةً بِالسَّيْفِ أَخَذَتْ مِنْهُ مَا أَخَذَتْ وَ إِنْ كَانَتْ تَابَعَتْهُ ضُرِبَتْ ضَرْبَةً بِالسَّيْفِ أَخَذَتْ مِنْهَا مَا أَخَذَتْ" قِيلَ وَ مَنْ يَضْرِبُهُمَا وَ لَيْسَ لَهُمَا خَصْمٌ قَالَ "ذَلِكَ إِلَى اَلْإِمَامِ إِذَا رُفِعَا إِلَيْهِ".

2. Abu Ali al-Ash ‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from abu ‘Abd Allah, ibn Bukayr from abu Basir who has narrated the following

“Abu ‘Abd Allah (a.s.), has said, ‘In the matters of your blood (lives), Allah has judged differently from His judging in matters of your assets. In matters of your assets and belongings, He has judged by means of placing the establishment of testimony (burden of proof) on the plaintiff and oath on the defendant. In matters of your blood (lives), He has placed establishment of testimony (burden of proof) on the defendant, and oath on the plaintiff so that the blood (life) of a Muslim is not invalidated.’”

2- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ بُكَيْرٍ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ

إِنَّ اللهَ حَكَمَ فِي دِمَائِكُمْ بِغَيْرِ مَا حَكَمَ بِهِ فِي أَمْوَالِكُمْ حَكَمَ فِي أَمْوَالِكُمْ أَنَّ الْبَيِّنَةَ عَلَى الْمُدَّعِي وَالْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ وَحَكَمَ فِي دِمَائِكُمْ أَنَّ الْبَيِّنَةَ عَلَى مَنِ ادُّعِيَ عَلَيْهِ وَالْيَمِينَ عَلَى مَنِ ادَّعَى لِكَيْلا يَبْطُلَ دَمُ امْرِئٍ مُسْلِمٍ.

hadith 641

1. We were told by Muhammed bin Hasan bin Ahmad bin Waleed, may Allah be pleasedwith him, that he said: We were told by Hussain ibn Hasan bin Aban, from Hussain bin Sa’eed, from Qasem bin Urwa, from Ibn Bukair, from Zurara, from Abu Abdillah, peace be upon him, that he said

For a muwaddiha are five camels, and for a samhaq are four camels, and for a badi’a are three camels, and for a ma’mura are thirty-three camels, and for a ja’ifa are thirty-three camels, and for a munqila are fifteen camels.

حدثنا محمد بن الحسن بن أحمد بن الوليد - رضي الله عنه - قال: حدثنا الحسين ابن الحسن بن أبان، عن الحسين بن سعيد، عن القاسم بن عروة، عن ابن بكير، عن زرارة، عن أبي عبد الله عليه السلام قال

في الموضحة خمس من الإبل، وفي السمحاق أربع من الإبل، وفي الباضعة ثلاث من الإبل، وفي المأمومة ثلاث وثلاثون من الإبل، وفي الجائفة ثلاث وثلاثون من الإبل، وفي المنقلة خمس عشرة من الإبل.

Hadith.5164 - Al-Hasan ibn Mahbub narrated from Abdullah ibn Sinan and Ibn Bukayr from Abu Abdullah (as), who was asked about a believer who intentionally kills another believer - does he have repentance? Imam (as) said

"If he killed him because of his faith, then there is no repentance for him. But if he killed him out of anger or due to some worldly reason, then his repentance is that retribution be taken from him. If no one knows about it, he should go to the family of the murdered person and confess to them that he killed their relative. If they forgive him and do not kill him, he must give them the blood money (diyyah), free a slave, fast for two consecutive months, and feed sixty needy people as repentance to Allah (swt), the Almighty and Majestic."

5164 - وَ رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ عَبْدِ اَللَّهِ بْنِ سِنَانٍ وَ اِبْنِ بُكَيْرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ

سُئِلَ عَنِ اَلْمُؤْمِنِ يَقْتُلُ اَلْمُؤْمِنَ مُتَعَمِّداً لَهُ تَوْبَةٌ فَقَالَ "إِنْ كَانَ قَتَلَهُ لِإِيمَانِهِ فَلاَ تَوْبَةَ لَهُ وَ إِنْ كَانَ قَتَلَهُ لِغَضَبٍ أَوْ لِسَبَبِ شَيْءٍ مِنْ أَمْرِ اَلدُّنْيَا فَإِنَّ تَوْبَتَهُ أَنْ يُقَادَ مِنْهُ وَ إِنْ لَمْ يَكُنْ عَلِمَ بِهِ أَحَدٌ اِنْطَلَقَ إِلَى أَوْلِيَاءِ اَلْمَقْتُولِ فَأَقَرَّ عِنْدَهُمْ بِقَتْلِ صَاحِبِهِمْ فَإِنْ عَفَوْا عَنْهُ فَلَمْ يَقْتُلُوهُ أَعْطَاهُمْ اَلدِّيَةَ وَ أَعْتَقَ نَسَمَةً وَ صَامَ "شَهْرَيْنِ مُتَتٰابِعَيْنِ"- وَ أَطْعَمَ سِتِّينَ مِسْكِيناً تَوْبَةً إِلَى اَللَّهِ عَزَّ وَ جَلَّ".
