hadith 151
3. Ali ibn Ibrahim has narrated from his father from Hammad from Aban ibn Th’alabah who has narrated the following
“Abu Ja‘far (a.s.), has said, ‘A part is one-tenth because the mountains were ten and the birds were four.’”
3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ أَبَانِ بْنِ تَغْلِبَ قَالَ
قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) الْجُزْءُ وَاحِدٌ مِنْ عَشَرَةٍ لأنَّ الْجِبَالَ عَشَرَةٌ وَالطُّيُورَ أَرْبَعَةٌ.

hadith 502
Hadith.5473 - Aban ibn Taghlib narrated from Imam Ali ibn Al-Hussain (as) that Imam (as) was asked about a man who made a bequest (waṣiyyah) of something from his wealth. Imam (as) replied
"The portion specified in the Book of (Imam) Ali (as) is one out of six parts."
5473 - رَوَى أَبَانُ بْنُ تَغْلِبَ عَنْ عَلِيِّ بْنِ اَلْحُسَيْنِ عَلَيْهِمَا اَلسَّلاَمُ : أَنَّهُ سُئِلَ عَنْ رَجُلٍ أَوْصَى بِشَيْءٍ مِنْ مَالِهِ فَقَالَ
"اَلشَّيْءُ فِي كِتَابِ عَلِيٍّ عَلَيْهِ اَلسَّلاَمُ وَاحِدٌ مِنْ سِتَّةٍ".

hadith 461
Hadith.5430 - Ṣafwan narrated from Murazim from some of our companions regarding a man who gives something from his wealth during his illness. Imam (as) said
"If he gives it explicitly (clearly handing it over), then it is valid. But if he bequeaths it (without handing it over), then it must be from one-third of his estate."
5430 - وَ رَوَى صَفْوَانُ عَنْ مُرَازِمٍ عَنْ بَعْضِ أَصْحَابِنَا : فِي اَلرَّجُلِ يُعْطِي اَلشَّيْءَ مِنْ مَالِهِ فِي مَرَضِهِ قَالَ
"إِذَا أَبَانَ بِهِ فَهُوَ جَائِزٌ وَ إِنْ أَوْصَى بِهِ فَمِنَ اَلثُّلُثِ".

hadith 496
Hadith.5467 - And the confirmation of this is what Ṣafwan narrated from Murazim regarding a man who gives something from his wealth during his illness. Imm (as) said
"If he clearly transfers it (during his lifetime), then it is valid. However, if he bequeaths it (for after his death), then it is only from one-third of his wealth."
5467 - وَ تَصْدِيقُ ذَلِكَ- مَا رَوَاهُ صَفْوَانُ عَنْ مُرَازِمٍ‌ فِي الرَّجُلِ يُعْطِي الشَّيْ‌ءَ مِنْ مَالِهِ فِي مَرَضِهِ قَالَ
إِذَا أَبَانَ بِهِ فَهُوَ جَائِزٌ وَ إِنْ أَوْصَى بِهِ فَمِنَ الثُّلُثِ.

Hadith.5450 - Muhammad ibn Abi Umayr narrated from Aban ibn Uthman from Abd Al-Rahman ibn Abi Abdullah from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as), who said
"When a boy reaches the age of ten, his will becomes valid."
5450 - رَوَى مُحَمَّدُ بْنُ أَبِي عُمَيْرٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ عَبْدِ اَلرَّحْمَنِ بْنِ أَبِي عَبْدِ اَللَّهِ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ
أَنَّهُ قَالَ : "إِذَا بَلَغَ اَلْغُلاَمُ عَشْرَ سِنِينَ جَازَتْ وَصِيَّتُهُ".

3. Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from certain persons of his people from Aban ibn ‘Uthman from ‘Abd al-Rahman ibn abu ‘Abd Allah who has narrated the following
“Abu ‘Abd Allah (a.s.), has said, ‘When a boy becomes ten years old his will is permissible.’”

قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِذَا بَلَغَ الْغُلامُ عَشْرَ سِنِينَ جَازَتْ وَصِيَّتُهُ.

5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Aban who has narrated the following
“In the case of a will for which there is no witness except a woman, abu ‘Abd Allah (a.s.), accepted it (such witness) for one-fourth of the will according to her testimony.’”

أَنَّهُ قَالَ فِي وَصِيَّةٍ لَمْ يَشْهَدْهَا إِلا امْرَأَةٌ فَأَجَازَ شَهَادَةَ الْمَرْأَةِ فِي الرُّبُعِ مِنَ الْوَصِيَّةِ بِحِسَابِ شَهَادَتِهَا.

11. Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Aban from Muhammad ibn Marwan who has narrated the following
“The Shaykh (a.s.), has said that abu Ja‘far (a.s.), died and left sixty slaves of whom he set free one-third and I determined such slaves by raffle and took the one-third away.’”

أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) مَاتَ وَتَرَكَ سِتِّينَ مَمْلُوكاً فَأَعْتَقَ ثُلُثَهُمْ فَأَقْرَعْتُ بَيْنَهُمْ وَأَخْرَجْتُ الثُّلُثَ.

hadith 532
Hadith.5503 - Aban ibn Uthman narrated from Muhammad ibn Marwan from the Shaykh, meaning Imam Musa ibn Jafar Al-Kadhim (as), from his father, Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as), peace be upon them both, that Imam (as) said
"Indeed, Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as), passed away and left sixty servants. He freed one-third of them, then I drew lots among the remaining ones and freed another one-third."
5503 - وَ رَوَى أَبَانُ بْنُ عُثْمَانَ عَنْ مُحَمَّدِ بْنِ مَرْوَانَ عَنِ اَلشَّيْخِ يَعْنِي مُوسَى بْنَ جَعْفَرٍ عَنْ أَبِيهِ عَ
أَنَّهُ قَالَ : "إِنَّ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ مَاتَ وَ تَرَكَ سِتِّينَ مَمْلُوكاً فَأَعْتَقَ ثُلُثَهُمْ فَأَقْرَعْتُ بَيْنَهُمْ وَ أَعْتَقْتُ اَلثُّلُثَ".

hadith 1079
2. Ali ibn Ibrahim has narrated from Salih al-Sindiy from Ja’far ibn Bashir from Aban ibn ‘Uthman from ‘Umar ibn Yazid who has said the following
“This is about a man who in his will has said to perform al-Hajj for him and his asset is not enough to perform it from al-Kufah. Abu ‘Abd Allah (a.s.), has said, ‘It is sufficient to perform it from any place before Miqat (place for assuming the state of Ihram).”’
2ـ عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ صَالِحِ بْنِ السِّنْدِيِّ عَنْ جَعْفَرِ بْنِ بَشِيرٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ عُمَرَ بْنِ يَزِيدَ قَالَ
قَالَ أَبُو عَبْدِ الله (عَلَيْهِ السَّلاَم) فِي رَجُلٍ أُوصِيَ بِحَجَّةٍ فَلَمْ تَكْفِهِ مِنَ الْكُوفَةِ إِنَّهَا تُجْزِئُ حَجَّتُهُ مِنْ دُونِ الْوَقْتِ.

hadith 152
1. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Muhammad ibn ‘Amr from Jamil from Aban who has narrated the following
“Ali ibn al-Husayn, ‘Alayhim al-Salam, was asked about the case of a man who made a will about something of his legacy. He (the Imam) said, ‘According to the book of Ali (a.s.), it is one-sixth.”’
1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ مُحَمَّدِ بْنِ عَمْرٍو عَنْ جَمِيلٍ عَنْ أَبَانٍ عَنْ عَلِيِّ بْنِ الْحُسَيْنِ (عَلَيْهِما السَّلام) أَنَّهُ سُئِلَ عَنْ رَجُلٍ أَوْصَى بِشَيْ‏ءٍ مِنْ مَالِهِ فَقَالَ

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from ibn Faddal or others from Jamil from Aban who has narrated the following
“Ali ibn al-Husayn, ‘Alayhim al-Salam, was asked about the case of a man who made a will about something of his wealth. He (the Imam) said, ‘According to the book of Ali (a.s.), it is one-sixth.’”

سُئِلَ عَنْ رَجُلٍ أَوْصَى بِشَيْ‏ءٍ مِنْ مَالِهِ قَالَ الشَّيْ‏ءُ فِي كِتَابِ عَلِيٍّ (عَلَيْهِ السَّلام) مِنْ سِتَّةٍ.

6. Muhammad ibn ’Isma’il has narrated from al-Fadl ibn Shadhan from and Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar all from Safwan from Murazim from certain persons of our people who has narrated the following
“About the case of a man who gives a certain amount of his property during his illness, abu ‘Abd Allah (a.s.), has said, ‘If he keeps such assets aside, it then is permissible, but if he has only said so in his will then it is from one-third of his legacy.’”
6- مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ وَأَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ جَمِيعاً عَنْ صَفْوَانَ عَنْ مُرَازِمٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ يُعْطِي الشَّيْ‏ءَ مِنْ مَالِهِ فِي مَرَضِهِ فَقَالَ
إِذَا أَبَانَ فِيهِ فَهُوَ جَائِزٌ وَإِنْ أَوْصَى بِهِ فَهُوَ مِنَ الثُّلُثِ.

2. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from certain persons of his people from Aban ibn ‘Uthman from Mansur ibn Hazim who has narrated the following
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who dies and leaves behind an owned slave, but certain ones of the heirs testify that he is free. He (the Imam) said, ‘If the testifying person is an acceptable person his testimony is permissible on his share of the legacy and the slave is made to work to buy his freedom from the rest of the heirs.’”
2- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ بَعْضِ أَصْحَابِهِ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ مَنْصُورِ بْنِ حَازِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ
سَأَلْتُهُ عَنْ رَجُلٍ مَاتَ وَتَرَكَ غُلاماً مَمْلُوكاً فَشَهِدَ بَعْضُ الْوَرَثَةِ أَنَّهُ حُرٌّ فَقَالَ إِنْ كَانَ الشَّاهِدُ مَرْضِيّاً جَازَتْ شَهَادَتُهُ فِي نَصِيبِهِ وَاسْتُسْعِيَ فِيمَا كَانَ لِغَيْرِهِ مِنَ الْوَرَثَةِ.

hadith 369
1. My father, may Allah grant him mercy, said: We were told by Muhammed bin Yahya al-‘Attar, from Muhammed bin Ahmad, from Ali bin Sindi, from Muhammed bin Amru bin Sa’eed, from Jameel, from Aban bin Taghlib, from Abu Hamza, from Ali bin Hussain, Allah’s blessings be upon them both, that he said
I said to him: A man who bequeaths with something of his property? Then he said to me: (It is mentioned) In the Book of Ali, peace be upon him: Something of his property is (equivalent to) one of six.
أبي - رحمه الله - قال: حدثنا محمد بن يحيى العطار، عن محمد بن أحمد، عن علي بن السندي، عن محمد بن عمرو بن سعيد، عن جميل، عن أبان بن تغلب، عن أبي حمزة، عن علي بن الحسين صلوات الله عليهما، قال
قلت له: رجل أوصى بشئ من ماله؟ فقال لي: في كتاب علي عليه السلام: الشئ من ماله واحد من ستة.

hadith 90
2. Al-Husayn ibn Muhammad has narrated from Mu‘alla’ ibn Muhammad from certain persons of his people from Aban ibn ‘Uthman from a man who has narrated the following
“I once asked abu ‘ Abd Allah (a.s.), about the case of a man who makes a will and he is indebted. He (the Imam) said, ‘He (executor of the will) pays the debts first, then distributes the legacy among the heirs.’ I then asked, ‘What happens if what is assigned to pay debts is stolen and about who pays for the debt if it is deducted from the shares of the heirs?’ He (the Imam) said, ‘The heirs are not responsible for it but the executor of the will is responsible.’”
2- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنْ بَعْضِ أَصْحَابِهِ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ رَجُلٍ قَالَ
سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ أَوْصَى إِلَى رَجُلٍ وَعَلَيْهِ دَيْنٌ فَقَالَ يَقْضِي الرَّجُلُ مَا عَلَيْهِ مِنْ دَيْنِهِ وَيَقْسِمُ مَا بَقِيَ بَيْنَ الْوَرَثَةِ قُلْتُ فَسُرِقَ مَا كَانَ أَوْصَى بِهِ مِنَ الدَّيْنِ مِمَّنْ يُؤْخَذُ الدَّيْنُ أَمِنَ الْوَرَثَةِ قَالَ لا يُؤْخَذُ مِنَ الْوَرَثَةِ وَلَكِنَّ الْوَصِيَّ ضَامِنٌ لَهَا.

hadith 559
Hadith.5529 - In the narration of Aban ibn Uthman, it is reported that a man asked Abu Abdullah (as), about a man who had made a will appointing someone as his executor, stating that he had a debt upon him. Abu Abdullah (as), said
"The executor should settle the debt owed by the deceased and then distribute whatever remains among the heirs." The man then asked: "Should the executor distribute what was bequeathed for the debt? Should the debt be collected from the heirs or from the executor?" Imam (as) replied: "It is not to be taken from the heirs; rather, the executor is responsible for it."
5529 - وَ فِي رِوَايَةِ أَبَانِ بْنِ عُثْمَانَ قَالَ : سَأَلَ رَجُلٌ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ أَوْصَى إِلَى رَجُلٍ أَنَّ عَلَيْهِ دَيْناً فَقَالَ
"يَقْضِي اَلرَّجُلُ مَا عَلَيْهِ مِنْ دَيْنِهِ وَ يَقْسِمُ مَا بَقِيَ بَيْنَ اَلْوَرَثَةِ" قُلْتُ فَيُفَرِّقُ اَلْوَصِيُّ مَا كَانَ أُوصِيَ بِهِ فِي اَلدَّيْنِ مِمَّنْ يُؤْخَذُ اَلدَّيْنُ أَ مِنَ اَلْوَرَثَةِ أَمْ مِنَ اَلْوَصِيِّ فَقَالَ "لاَ يُؤْخَذُ مِنَ اَلْوَرَثَةِ وَ لَكِنَّ اَلْوَصِيَّ ضَامِنٌ لَهُ".

hadith 371
2. My father, may Allah grant him mercy, said: We were told by Sa’d bin Abdullah, from Ahmad bin Muhammed, from Ali bin Hakam, from Aban al-Ahmar, from Abdullah bin Sinan, that he said
I asked Abu Abdillah, peace be upon him, of a woman who bequeathed with her third, that the debt of the son of her brother is cleared with it, and that a part is for such-a-male and such-a-female, and I did not know (how to deal with) that, so we approached Ibn Abi Layla. He said: So what did he say to you? I said: He said: There is nothing to them. So he said: He has lied, by Allah. To them is a tenth of the third.
أبي - رحمه الله - قال: حدثنا سعد بن عبد الله، عن أحمد بن محمد، عن علي بن الحكم، عن أبان الأحمر، عن عبد الله بن سنان قال
سألت أبا عبد الله عليه السلام عن امرأة أوصت بثلثها يقضي به دين ابن أخيها وجزء لفلان وفلانة فلم أعرف ذلك، فقدمنا إلى ابن أبي ليلى. قال: فما قال لك؟ قلت: قال: ليس لهما شئ. فقال: كذب والله، لهما العشر من الثلث.

Hadith.5416 - Al-Abbas ibn Amir narrated from Aban from Abu Basir from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as), who said
"Whoever does not make a proper will at the time of death, it is a deficiency in his dignity and intellect." Imam (as) also said: "Indeed, the Messenger of Allah (swt) (peace be upon him and his family) made a will to Ali (as), and Ali (as) made a will to Al-Hasan (as), and Al-Hasan (as) made a will to Al-Hussain (as), and Al-Hussain (as) made a will to Ali ibn Al-Hussain (as), and Ali ibn Al-Hussain (as) made a will to Muhammad ibn Ali Al-Baqir (as)."
5416 - رَوَى اَلْعَبَّاسُ بْنُ عَامِرٍ عَنْ أَبَانٍ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ
"مَنْ لَمْ يُحْسِنْ عِنْدَ اَلْمَوْتِ وَصِيَّتَهُ كَانَ نَقْصاً فِي مُرُوءَتِهِ وَ عَقْلِهِ " وَ قَالَ "إِنَّ رَسُولَ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَ آلِهِ أَوْصَى إِلَى عَلِيٍّ عَلَيْهِ اَلسَّلاَمُ وَ أَوْصَى عَلِيٌّ إِلَى اَلْحَسَنِ وَ أَوْصَى اَلْحَسَنُ عَلَيْهِ اَلسَّلاَمُ إِلَى اَلْحُسَيْنِ وَ أَوْصَى اَلْحُسَيْنُ عَلَيْهِ اَلسَّلاَمُ إِلَى عَلِيِّ بْنِ اَلْحُسَيْنِ وَ أَوْصَى عَلِيُّ بْنُ اَلْحُسَيْنِ عَلَيْهِمَا اَلسَّلاَمُ إِلَى مُحَمَّدِ بْنِ عَلِيٍّ اَلْبَاقِرِ عَلَيْهِ اَلسَّلاَمُ ".

1. We were told by Muhammed bin Hasan bin Ahmad bin Waleed, may Allah be pleased with him, that he said: We were told by Ahmad bin Idrees, from Muhammed bin Ahmad bin Yahya bin Imran al-Ash’ari, from Ali bin Sindi, from Muhammed bin Amru bin Sa’eed, from Jameel, from Aban bin Taghlib, from Abu Ja’far, peace be upon him, that he said
with regards to a man who bequeaths with a part of his property, that a part is one of ten, because Allah, Exalted and Glorious is He, says: «Then place upon each mountain of them, a part» (2:260) and the mountains were ten and the birds were four, and so he placed on each mountain of them, a part.
حدثنا محمد بن الحسن بن أ��مد بن الوليد - رضي الله عنه - قال: حدثنا أحمد ابن إدريس، عن محمد بن أحمد بن يحيى بن عمران الأشعري، عن علي بن السندي، عن محمد بن عمرو بن سعيد، عن جميل، عن أبان بن تغلب، عن أبي جعفر عليه السلام
أنه قال في الرجل يوصي بجزء من ماله إن الجزء واحد من عشرة، لان الله عز وجل يقول: " ثم اجعل على كل جبل منهن جزءا وكانت الجبال عشرة والطير أربعة فجعل على كل جبل منهن جزءا.
