hadith 1463
Hadith.4678 - Ali ibn Ja'far asked his brother Imam Musa ibn Jafar Al-Kadhim (as) about a woman who committed adultery - whether she is suitable to be taken as a wet nurse. He (as) replied: "She is not suitable, nor is the milk of her daughter who was born from adultery."
4678 - وَ سَأَلَ عَلِيُّ بْنُ جَعْفَرٍ أَخَاهُ مُوسَى بْنَ جَعْفَرٍ عَلَيْهِمَا اَلسَّلاَمُ : عَنِ اِمْرَأَةٍ زَنَتْ هَلْ تَصْلُحُ أَنْ تُسْتَرْضَعَ قَالَ
"لاَ تَصْلُحُ وَ لاَ لَبَنُ اِبْنَتِهَا اَلَّتِي وُلِدَتْ مِنَ اَلزِّنَا".

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ‘Isma’il ibn Hammam from Ali ibn Ja’far who has said the following
“I once asked abu al-Hassan (a.s.), about the case of a man who kisses the vagina of a woman. He (the Imam) said, ‘It is not unlawful.’”
4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ إِسْمَاعِيلَ بْنِ هَمَّامٍ عَنْ عَلِيِّ بْنِ جَعْفَرٍ قَالَ
سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يُقَبِّلُ قُبُلَ الْمَرْأَةِ قَالَ لا بَأْسَ.

Hadith.4451 - Ali ibn Ja'far narrated from his brother Imam Musa ibn Jafar Al-Kadhim (as)
I asked Imam (as) about a man who married a woman but did not consummate the marriage and then committed adultery. Imam (as) said: "He shall be lashed with the prescribed punishment (hadd), his head shall be shaved, he shall be separated from his wife, and he shall be exiled for one year."
4451 - وَ رَوَى عَلِيُّ بْنُ جَعْفَرٍ عَنْ أَخِيهِ مُوسَى بْنِ جَعْفَرٍ عَلَيْهِمَا اَلسَّلاَمُ قَالَ
سَأَلْتُهُ عَنْ رَجُلٍ تَزَوَّجَ بِامْرَأَةٍ فَلَمْ يَدْخُلْ بِهَا فَزَنَى مَا عَلَيْهِ قَالَ "يُجْلَدُ اَلْحَدَّ وَ يُحْلَقُ رَأْسُهُ وَ يُفَرَّقُ بَيْنَهُ وَ بَيْنَ أَهْلِهِ وَ يُنْفَى سَنَةً".

Hadith.4444 - Ali ibn Jafar narrated from his brother Imam Musa ibn Jafar Al-Kadhim (as) that
he said: I asked him about a man who said to his female slave, "I have freed you and made your emancipation your dowry." Imam (as) replied: "She is freed, and she has the choice, if she wishes, she may marry him, and if she wishes, she may not. If she marries him, then he should give her something. However, if he said: 'I have married you and made your dowry your emancipation,' then the marriage is valid, and he does not have to give her anything."
4444 - وَ رَوَى عَلِيُّ بْنُ جَعْفَرٍ عَنْ أَخِيهِ مُوسَى بْنِ جَعْفَرٍ عَلَيْهِمَا اَلسَّلاَمُ قَالَ
سَأَلْتُهُ عَنْ رَجُلٍ قَالَ لِأَمَتِهِ أَعْتَقْتُكِ وَ جَعَلْتُ عِتْقَكِ مَهْرَكِ قَالَ "عَتَقَتْ وَ هِيَ بِالْخِيَارِ إِنْ شَاءَتْ تَزَوَّجَتْهُ وَ إِنْ شَاءَتْ فَلاَ فَإِنْ تَزَوَّجَتْهُ فَلْيُعْطِهَا شَيْئاً فَإِنْ قَالَ قَدْ تَزَوَّجْتُكِ وَ جَعَلْتُ مَهْرَكِ عِتْقَكِ فَإِنَّ اَلنِّكَاحَ وَاقِعٌ وَ لاَ يُعْطِيهَا شَيْئاً ".

2. Certain persons of our people have narrated from Ali ibn al-Hassan al-Taymuliy from Ali ibn Asbat from Muhammad ibn Ali ibn Ja‘far who has said the following
“Once al-Ma’mun asked al-Rida’ (a.s.), about the words of Allah, most Majestic, most Glorious, ‘. . . you must not send them out of their homes and they must not go out except if they commit an open indecent act’ He (the Imam) said, . . ‘open indecent act’, is a reference to her troubling the family of the man. If she did he can send her out, if he wants, before the end of her waiting period.’”
بَعْضُ أَصْحَابِنَا عَنْ عَلِيِّ بْنِ الْحَسَنِ التَّيْمُلِيِّ عَنْ عَلِيِّ بْنِ أَسْبَاطٍ عَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ جَعْفَرٍ قَالَ
سَأَلَ الْمَأْمُونُ الرِّضَا ( عليه السلام ) عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَ لا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفاحِشَةٍ مُبَيِّنَةٍ قَالَ يَعْنِي بِالْفَاحِشَةِ الْمُبَيِّنَةِ أَنْ تُؤْذِيَ أَهْلَ زَوْجِهَا فَإِذَا فَعَلَتْ فَإِنْ شَاءَ أَنْ يُخْرِجَهَا مِنْ قَبْلِ أَنْ تَنْقَضِيَ عِدَّتُهَا فَعَلَ .

5. A number of our people have narrated from Sahl ibn Ziyad from Musa ibn al-Qasim al-Bajaliy and Muhammad ibn Yahya has narrated from al-‘Amrakiy ibn Ali all from Ali ibn Ja’far from his brother, , who has said the following
“Abu al-Hassan, Musa (a.s.) has said that Allah, most Majestic, most Glorious, made al- Hajj obligatory for people of Jaddah every year because of His words, ‘It is obligatory upon people from Allah to perform al-Hajj who are able to do so. Those who refuse must take notice that Allah is independent of all people.’ (3:96) I then asked him (the Imam); ‘Does one of us for not performing al- Hajj become an unbeliever?’ He (the Imam) said, ‘However, if he says, ‘This is not as such then he becomes one who hides the truth (an unbeliever).”’
5ـ عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُوسَى بْنِ الْقَاسِمِ الْبَجَلِيِّ وَمُحَمَّدُ بْنُ يَحْيَى عَنِ الْعَمْرَكِيِّ بْنِ عَلِيٍّ جَمِيعاً عَنْ عَلِيِّ بْنِ جَعْفَرٍ عَنْ أَخِيهِ مُوسَى (عَلَيْهِ السَّلاَم) قَالَ
إِنَّ الله عَزَّ وَجَلَّ فَرَضَ الْحَجَّ عَلَى أَهْلِ الْجِدَةِ فِي كُلِّ عَامٍ وَذَلِكَ قَوْلُهُ عَزَّ وَجَلَّ وَلله عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطاعَ إِلَيْهِ سَبِيلاً وَمَنْ كَفَرَ فَإِنَّ الله غَنِيٌّ عَنِ الْعالَمِينَ قَالَ قُلْتُ فَمَنْ لَمْ يَحُجَّ مِنَّا فَقَدْ كَفَرَ قَالَ لا وَلَكِنْ مَنْ قَالَ لَيْسَ هَذَا هَكَذَا فَقَدْ كَفَرَ.
