Hadith 1230
Hadith.4444 - Ali ibn Jafar narrated from his brother Imam Musa ibn Jafar Al-Kadhim (as) that he said
I asked him about a man who said to his female slave, "I have freed you and made your emancipation your dowry." Imam (as) replied: "She is freed, and she has the choice, if she wishes, she may marry him, and if she wishes, she may not. If she marries him, then he should give her something. However, if he said: 'I have married you and made your dowry your emancipation,' then the marriage is valid, and he does not have to give her anything."
4444 - وَ رَوَى عَلِيُّ بْنُ جَعْفَرٍ عَنْ أَخِيهِ مُوسَى بْنِ جَعْفَرٍ عَلَيْهِمَا اَلسَّلاَمُ قَالَ
سَأَلْتُهُ عَنْ رَجُلٍ قَالَ لِأَمَتِهِ أَعْتَقْتُكِ وَ جَعَلْتُ عِتْقَكِ مَهْرَكِ قَالَ "عَتَقَتْ وَ هِيَ بِالْخِيَارِ إِنْ شَاءَتْ تَزَوَّجَتْهُ وَ إِنْ شَاءَتْ فَلاَ فَإِنْ تَزَوَّجَتْهُ فَلْيُعْطِهَا شَيْئاً فَإِنْ قَالَ قَدْ تَزَوَّجْتُكِ وَ جَعَلْتُ مَهْرَكِ عِتْقَكِ فَإِنَّ اَلنِّكَاحَ وَاقِعٌ وَ لاَ يُعْطِيهَا شَيْئاً ".
