"The wealth belongs to the daughter, and the full sister has no share in it."

“Abu Ja‘far (a.s.), has said, ‘Women do not inherit from the real property or land anything.’”

“This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who dies owing a certain amount of debts and leaves behind a slave who has his assets in business and a son. In the hand of the slave he leaves the assets, goods and debts owed by the slave which he had incurred during the lifetime of his master for business. The heir and creditors dispute about what is in the hand of the slave, the slave himself and the assets and goods. He (the Imam) said, ‘In my view the heirs have no say about the slave or about what is in his hand of assets and goods, except if they take responsibility for the debt for all the creditors. Thereafter the slave and what is in his hand of the assets and goods all go in the hands of the heirs; but if they refuse to take responsibility, the slave and all that is in his hand go to the creditors. The slave and whatever is in his hand of the assets are distributed among the creditors proportionate to their shares. If the slave and the asset could not pay the debts the creditors can ask the heirs for the remaining liabilities if the deceased has left anything. If the slave and assets exceed the debts the remaining goes to the heirs.’”

"The mother receives one-third, and the father receives two-thirds."

I asked Abu Abdullah (as) about a man who died and left behind his full brother (from the same father and mother) and his grandfather. Imam (as) said: "The inheritance is divided among them as if they were two brothers or even a hundred. The grandfather is considered as one of them; he receives a share equal to that of one of the brothers."

"When a man divorces his wife, they inherit from one another as long as she is in her waiting period (iddah). However, if he divorces her for the third time, he has no right to take her back, and there is no inheritance between them."

I asked Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) and he had one brother residing in the land of migration (Dar Al-Hijrah) and another brother in the land of the Bedouins (Dar Al-Badw), who had not migrated. I asked: "If the migrant (Muhajir) brother pardons the killer, but the Bedouin brother wants to execute retaliation (Qisas), does he have the right to do so?" Imam (as) replied: "The Bedouin has no right to kill a migrant until he himself migrates. However, if the migrant pardons the killer, his pardon is valid." I asked: "Does the Bedouin have any share in the inheritance?" Imam (as) said: "As for inheritance, he has a share, and he is entitled to his portion of his slain brother's blood money (Diyyah) if it is taken."

"The Commander of the Faithful (as) ruled regarding the child of mula'anah that his mother inherits one-third, and the remainder belongs to the Imam because any liability for his actions falls upon the Imam."

"The inheritance of the child of mula'anah belongs to his mother. If his mother is not alive, then it goes to the closest relatives on his mother's side - his maternal uncles."

‘The Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, provided for the grandmother one-sixth as food.’”

“About the case of a man who dies and leaves behind his daughter and his sister from his father and mother, he (the Imam) said, ‘The legacy belongs to his daughter and there is nothing for the sister from his father and mother.’”

“I once asked abu ‘Abd Allah (a.s.), about the case of a man who leaves behind his brother from his father and mother and his grandfather. He (the Imam) said, ‘The legacy between them is half and half. If they are two brothers or a hundred, the grandfather is with them like one of them. The grandfather with them receives a share like the share of one of the brothers.’ He (the Imam) said, ‘If he leaves behind a sister, then the shares of the grandfather are two shares and the sister receives one share, if the sisters were two, then one-half is for grandfather and one-half for the sisters.’ He (the Imam) said, ‘If he leaves behind brothers and sisters from his mother and father, the grandfather is like one of the brothers and each male receives twice as much as the share of a female.’”

“If a deceased leaves behind his mother, or father, or his son or his daughter with one of these four then what Allah, most Majestic, most Glorious, has spoken about, ‘Allah gives you a fatwa about al -Kalalah’ (4:176) does not apply. With the existence of the mother, father, son or daughter no one of the creatures of Allah, most Majestic, most Glorious, inherits except the husband and wife/”

“About the case of a man who dies and leaves behind his parents, abu Ja‘far (a.s.), has said, ‘The father receives two shares and the mother receives one share.”’

“I once asked him (the Imam) (a.s.), about the case of a woman who dies before his going to bed with her or her husband dies before going to bed with her. He (the Imam) said, ‘Whoever of them dies she deserves one-half of mahr (dower) which is set for her, but if it is not set for her then mahr (dower) is not payable to her.’”

“I once heard abu ‘Abd Allah (a.s.), saying about the words of Allah, ‘. . .for everyone We have made Mawali (guardians, heirs) in what the parents and relatives leave behind,’ what is meant thereby are relatives in inheritance, not the benefactors who provide benefits. Thus the more deserving of a deceased is one who is nearest to him as a relative and womb, and the relationship which brings him toward it.’”

“Abu ’Abd Allah (a.s.), once said to me, ’O Zurarah, what do you say about the case of a man who leaves behind his both parents and brothers from his mother’s side?’ He (the narrator) has said that he said, ‘One-sixth is for the mother and the rest is for the father.’ He (the Imam) asked, ’On what basis do you say so?’ I replied, ‘I have heard Allah, most Majestic, most Glorious, saying in His book, ’. . . if there are brothers then one-sixth is for his mother.’ (4:11) He (the Imam) said, ’Fie on you O Zurarah, they are brothers from the father’s side. If brothers are from the mother’s side, they do not bar the mother from receiving the one-third.’”

“I found in the book of ordained shares that if a deceased leaves behind his daughter and both parents, the share of the daughter are three shares and the parents each receives one share. The legacy is made in five parts of which three are for the daughter and two for the parents, one share each.’”

“Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, provided for the grandmother one-sixth but did not sanction anything for her.’”

“I once asked abu Ja‘far (a.s.), about the case of a man who divorces his wife. He (the Imam) said, ‘She inherits him and he inherits her as long as he has the right to go back to her.’”
