Hadith 715

Hadith.5675 - Al-Hasan ibn Mahbub narrated from Ibn Mihzam, from Talhah ibn Zayd, who said that Abu Abdullah (as) said
"Child in the womb (hamil) will not inherit except with clear evidence."
Imam (as) explained: "The hamil is the child carried by a pregnant woman who was captured while pregnant, and later the father or the brother recognizes the child as theirs."
5675 - رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنِ اِبْنِ مِهْزَمٍ عَنْ طَلْحَةَ بْنِ زَيْدٍ قَالَ
قَالَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : "لاَ يُوَرَّثُ اَلْحَمِيلُ إِلاَّ بِبَيِّنَةٍ" قَالَ "وَ اَلْحَمِيلُ هُوَ اَلَّذِي تَأْتِي بِهِ اَلْمَرْأَةُ حُبْلَى قَدْ سُبِيَتْ وَ هِيَ حُبْلَى فَيَعْرِفُهُ بِذَلِكَ بَعْدُ أَبُوهُ أَوْ أَخُوهُ".
