Hadith 494

Hadith.5464 - It was narrated from Abu Ṭalib Abdullah ibn Al-Ṣalt Al-Qummi that he said:
Al-Khalil ibn Hashim wrote to Dhu Al-Ri'asatayn, who was the governor of Nishapur, informing him that
a man from the Magians had passed away and had bequeathed a portion of his wealth to the poor.
The executor in Nishapur took that wealth and distributed it among the poor Muslims.
Al-Khalil wrote to Dhu Al-Riʾasatayn about this matter, and Dhu Al-Riʾasatayn consulted Al-Maʾmun, who said: "I have no ruling on this issue."
Then he asked Abu Al-Hasan (as), and Abu Al-Hasan (as) replied:
"The Magian did not bequeath his wealth to the poor Muslims. Therefore, it is appropriate that an equivalent amount from the charity funds be taken and returned to the poor among the Magians."
5464 - وَ رُوِيَ عَنْ أَبِي طَالِبٍ عَبْدِ اَللَّهِ بْنِ اَلصَّلْتِ اَلْقُمِّيِّ
أَنَّهُ قَالَ : كَتَبَ اَلْخَلِيلُ بْنُ هَاشِمٍ إِلَى ذِي اَلرِّئَاسَتَيْنِ وَ هُوَ وَالِي نَيْسَابُورَ أَنَّ رَجُلاً مِنَ اَلْمَجُوسِ مَاتَ وَ أَوْصَى لِلْفُقَرَاءِ بِشَيْءٍ مِنْ مَالِهِ فَأَخَذَهُ اَلْوَصِيُّ بِنَيْسَابُورَ فَجَعَلَهُ فِي فُقَرَاءِ اَلْمُسْلِمِينَ فَكَتَبَ اَلْخَلِيلُ إِلَى ذِي اَلرِّئَاسَتَيْنِ بِذَلِكَ فَسَأَلَ اَلْمَأْمُونَ عَنْ ذَلِكَ فَقَالَ لَيْسَ عِنْدِي فِي ذَلِكَ شَيْءٌ فَسَأَلَ أَبَا اَلْحَسَنِ عَلَيْهِ اَلسَّلاَمُ فَقَالَ أَبُو اَلْحَسَنِ عَلَيْهِ اَلسَّلاَمُ "إِنَّ اَلْمَجُوسِيَّ لَمْ يُوصِ لِفُقَرَاءِ اَلْمُسْلِمِينَ وَ لَكِنْ يَنْبَغِي أَنْ يُؤْخَذَ مِقْدَارُ ذَلِكَ اَلْمَالِ مِنْ مَالِ اَلصَّدَقَةِ فَيُرَدَّ عَلَى فُقَرَاءِ اَلْمَجُوسِ ".
