Man Lā Yaḥḍuruh al-Faqīh
Hadith 395005 - وَ رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ عَنْ سُلَيْمَانَ بْنِ خَالِدٍ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : فِي غُلاَمٍ صَغِيرٍ لَمْ يُدْرِكِ اِبْنِ عَشْرِ سِنِينَ زَنَى بِامْرَأَةٍ قَالَ "يُجْلَدُ اَلْغُلاَمُ دُونَ اَلْحَدِّ وَ تُضْرَبُ اَلْمَرْأَةُ اَلْحَدَّ كَامِلاً" قُلْتُ فَإِنْ كَانَتْ مُحْصَنَةً قَالَ "لاَ تُرْجَمُ لِأَنَّ اَلَّذِي نَكَحَهَا لَيْسَ بِمُدْرِكٍ وَ لَوْ كَانَ مُدْرِكاً رُجِمَتْ".
Hadith.5005 - Narrated by Al-Hasan ibn Mahbub from Abu Ayyub, from Sulayman ibn Khalid, from Abu Basir, from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as) regarding a young boy who had not yet reached the age of ten and committed adultery with a woman.
Imam (as) said: "The boy is to be beaten with lashes but not subjected to the full prescribed punishment (hadd), whereas the woman is to be given the full hadd punishment."
I asked: "What if she was married (muhsanah)?"
Imam (as) replied: "She is not to be stoned because the one who had intercourse with her is not mature. However, if he had been mature, she would have been stoned."
