Hadith 153

Hadith.5121 - Imam Jafar ibn Muhammad Al-Sadiq (as) was asked about the saying of Allah (swt), the Mighty and Majestic:
"The punishment of those who wage war against Allah (swt) and His Messenger and strive to spread corruption on earth is that they be killed, or crucified, or have their hands and feet cut off from opposite sides, or be exiled from the land" (Surah Al-Ma'idah 5:33).
Imam (as) said
"If a person kills but does not engage in combat and does not take wealth, he is to be executed.
If he engages in combat and kills, he is to be killed and crucified.
If he engages in combat and takes wealth but does not kill, his hand and foot are to be cut off.
And if he engages in combat but does not kill and does not take wealth, he is to be exiled."
5121 - وَ سُئِلَ اَلصَّادِقُ عَلَيْهِ اَلسَّلاَمُ : عَنْ قَوْلِ اَللَّهِ عَزَّ وَ جَلَّ
إِنَّمٰا جَزٰاءُ اَلَّذِينَ يُحٰارِبُونَ اَللّٰهَ وَ رَسُولَهُ وَ يَسْعَوْنَ فِي اَلْأَرْضِ فَسٰاداً أَنْ يُقَتَّلُوا أَوْ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَ أَرْجُلُهُمْ مِنْ خِلاٰفٍ أَوْ يُنْفَوْا مِنَ اَلْأَرْضِ
فَقَالَ "إِذَا قَتَلَ وَ لَمْ يُحَارِبْ وَ لَمْ يَأْخُذِ اَلْمَالَ قُتِلَ وَ إِذَا حَارَبَ وَ قَتَلَ قُتِلَ وَ صُلِبَ وَ إِذَا حَارَبَ وَ أَخَذَ اَلْمَالَ وَ لَمْ يَقْتُلْ قُطِعَتْ يَدُهُ وَ رِجْلُهُ وَ إِذَا حَارَبَ وَ لَمْ يَقْتُلْ وَ لَمْ يَأْخُذِ اَلْمَالَ نُفِيَ".
