3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father from ‘Abd al- Rahman ibn abu Najran from ‘Abd Allah ibn Bukayr from Zurarah from al-Yasa’ who has said the following
“I once heard abu Ja‘far (a.s.), has stated this Hadith. ‘Divorce, which is not according to Sunnah, is not a divorce. A divorce is not according to Sunnah if it is not pronounced in the presence of two just witnesses, in a menses-free period in which the husband has not gone to bed with her. If a man divorces his wife in a menses-free period during which he has not gone to bed with her but it is not in presence (of two just) witnesses, such divorce is not a valid divorce. If a man divorces his wife according to Sunnah, in a menses-free period in which he has not gone to bed with her and pronounces it in the presence of witnesses but has not intended it to be a divorce it also is not a valid divorce.’”
