Hadith 544

Hadith.5515 - Al-Hasan ibn Ali Al-Washa' narrated from Muhammad ibn Yahya from the executor of Ali ibn Al-Sari, who said
I said to Abu Al-Hasan (as): "Ali ibn Al-Sari has passed away and appointed me as his executor."
Imam (as) said: "May Allah (swt) have mercy on him."
I said: "His son Ja'far committed an act with his father's umm walad (concubine), and he instructed me to exclude him from the inheritance."
Imam (as) said: "Exclude him if you are truthful, and he will suffer affliction."
He (the executor) said: I returned, and Ja'far brought me before Abu Yusuf the judge. Ja'far said to him, "May Allah (swt) rectify your affairs. I am Ja'far, the son of Ali ibn Al-Sari, and this is my father's executor. Order him to give me my inheritance from my father."
The judge asked me: "What do you say?"
I replied: "Yes, this is Ja'far, the son of Ali ibn Al-Sari, and I am his executor."
The judge said: "Then hand over his wealth to him."
I said: "I wish to speak with you."
He (the judge) said: "Come closer."
I approached him so that no one could hear me, and I said: "This man committed an act with his father's umm walad, and his father commanded me in his will to exclude him from the inheritance and not give him anything. I went to Imam Musa ibn Jafar Al-Kadhim (as), in Medina, informed him, and sought his guidance. Imam (as) ordered me to exclude him from the inheritance and not give him anything."
The judge said: "By Allah (swt), did Abu Al-Hasan command you to do this?"
I said: "Yes."
He (the judge) made me swear three times and then said: "Carry out what you were ordered. His (as) word is decisive."
The executor said: After that, Ja'far was afflicted with madness.
Abu Muhammad Al-Hasan ibn Ali Al-Washa' said: I saw him after that.
5515 - رَوَى اَلْحَسَنُ بْنُ عَلِيٍّ اَلْوَشَّاءُ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ وَصِيِّ عَلِيِّ بْنِ اَلسَّرِيِّ قَالَ
قُلْتُ لِأَبِي اَلْحَسَنِ عَلَيْهِ اَلسَّلاَمُ إِنَّ عَلِيَّ بْنَ اَلسَّرِيِّ تُوُفِّيَ وَ أَوْصَى إِلَيَّ فَقَالَ "رَحِمَهُ اَللَّهُ" قُلْتُ وَ إِنَّ اِبْنَهُ جَعْفَراً وَقَعَ عَلَى أُمِّ وَلَدٍ لَهُ فَأَمَرَنِي أَنْ أُخْرِجَهُ مِنَ اَلْمِيرَاثِ فَقَالَ لِي "أَخْرِجْهُ إِنْ كُنْتَ صَادِقاً فَسَيُصِيبُهُ خَبَلٌ " قَالَ فَرَجَعْتُ فَقَدَّمَنِي إِلَى أَبِي يُوسُفَ اَلْقَاضِي فَقَالَ لَهُ أَصْلَحَكَ اَللَّهُ أَنَا جَعْفَرُ بْنُ عَلِيِّ بْنِ اَلسَّرِيِّ وَ هَذَا وَصِيُّ أَبِي فَمُرْهُ أَنْ يَدْفَعَ إِلَيَّ مِيرَاثِي مِنْ أَبِي فَقَالَ لِي مَا تَقُولُ فَقُلْتُ نَعَمْ هَذَا جَعْفَرُ بْنُ عَلِيِّ بْنِ اَلسَّرِيِّ وَ أَنَا وَصِيُّ عَلِيِّ بْنِ اَلسَّرِيِّ قَالَ فَادْفَعْ إِلَيْهِ مَالَهُ فَقُلْتُ لَهُ أُرِيدُ أَنْ أُكَلِّمَكَ قَالَ فَادْنُ مِنِّي فَدَنَوْتُ حَيْثُ لاَ يَسْمَعُ أَحَدٌ كَلاَمِي فَقُلْتُ لَهُ هَذَا وَقَعَ عَلَى أُمِّ وَلَدٍ لِأَبِيهِ فَأَمَرَنِي أَبُوهُ وَ أَوْصَى إِلَيَّ أَنْ أُخْرِجَهُ مِنَ اَلْمِيرَاثِ وَ لاَ أُوَرِّثَهُ شَيْئاً فَأَتَيْتُ مُوسَى بْنَ جَعْفَرٍ عَلَيْهِمَا اَلسَّلاَمُ بِالْمَدِينَةِ فَأَخْبَرْتُهُ وَ سَأَلْتُهُ فَأَمَرَنِي أَنْ أُخْرِجَهُ مِنَ اَلْمِيرَاثِ وَ لاَ أُوَرِّثَهُ شَيْئاً فَقَالَ اَللَّهَ إِنَّ أَبَا اَلْحَسَنِ أَمَرَكَ فَقُلْتُ نَعَمْ فَاسْتَحْلَفَنِي ثَلاَثاً ثُمَّ قَالَ لِي أَنْفِذْ مَا أَمَرَكَ فَالْقَوْلُ قَوْلُهُ قَالَ اَلْوَصِيُّ فَأَصَابَهُ اَلْخَبَلُ بَعْدَ ذَلِكَ قَالَ أَبُو مُحَمَّدٍ اَلْحَسَنُ بْنُ عَلِيٍّ اَلْوَشَّاءُ رَأَيْتُهُ بَعْدَ ذَلِكَ.
