مسلم

"There is nothing upon him (no liability)."

"If a man has intercourse with the slave woman of his wife, then upon him is the same punishment as that of a fornicator."

3. Imam Muhammad Baqir (a.s.) narrates that the Holy Prophet (s.a.w.s.) said, “One who testifies falsely and as a result of which a Muslim’s blood is shed or his wealth is usurped, the testifier will be brought on the Day of Judgment with his face having blackness spread everywhere and having scratches on it. People will know him with his name and lineage. One who testifies truthfully and saves the right of another Muslim, his face will be brightened on the Day of Judgment with its light spreading everywhere on the Day of Judgment. He will also be known to the people with name and lineage. Did you not hear the saying of Allah, the Mighty and Sublime: and give upright testimony for Allah?”

Hadith.5039 - In the narration of Aṣim from Muhammad ibn Muslim, he said: I asked Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) about a man who commits adultery but has not consummated marriage with his wife. Is he considered muhsan (legally married and liable for stoning)? Imam (as) replied: "No, and not with a bondwoman (amah) either."

"He is to be flogged." I asked: "What if she pardons him?" Imam (as) said: "No, and no honor (for him)."

he was asked about a Muslim who gouged out the eye of a Christian. Imam (as) replied: "The blood money (diyyah) for the eye of a dhimmi (non-Muslim under Islamic protection) is four hundred dirhams."

"Commander of the Faithful (as) would assign the liability for the offense committed by a mentally impaired person (ma'tooh) to his family (Aqilah), whether it was accidental or intentional."

"The Messenger of Allah (swt) (peace be upon him and his family) said: 'Whoever is killed defending his wealth is a martyr.'" Imam (as) also said: "If it were me, I would have abandoned the wealth and not fought."

“We asked abu ‘ Abd Allah (a.s.), if testimony of women is acceptable in penalty cases. He (the Imam) said, ‘Only in murder cases it is acceptable. ’Amir al-Mu’minin, Ali (a.s.), would say, “The blood (life) of a Muslim cannot be invalidated.’””

"Every adult, whether male or female, who falsely accuses a minor or an adult, a male or a female, a Muslim, a free person, or a slave, is subject to the prescribed punishment (hadd Al-firya). And for one who is not yet an adult, the punishment is disciplinary (hadd Al-adab)."

I asked Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) about a mukatab (a slave who has a contract for gradual emancipation) who unintentionally killed a man. Imam (as) said: "If his master, when drafting the emancipation contract, stipulated that if he fails to fulfill the payment, he would return to slavery, then he is treated like a slave and handed over to the heirs of the murdered person. If they wish, they may enslave him, and if they wish, they may sell him. But if his master, when drafting the contract, did not make such a stipulation and the mukatab had already paid part of the contract amount, then Imam Ali ibn Abi Talib (as) used to say, 'He is freed in proportion to what he has paid of his contract, and it is upon the Imam to pay the heirs of the murdered person an amount equivalent to the portion of freedom the mukatab had earned. The blood of a Muslim must not be wasted.' I (as) also believe that regarding the remaining unpaid portion of the contract, the mukatab should remain as a slave to the heirs of the murdered person, serving them for the rest of his life in proportion to what remains of his contract, but they are not permitted to sell him."

"A believing slave must be freed in his place, and this is in accordance with the saying of Allah (swt), the Mighty and Majestic: 'But if he belonged to a people hostile to you and he was a believer, then the freeing of a believing slave [is required]' (Surah An-Nisa 4:92).

"During the time of the Commander of the Faithful (as), there was a truthful woman known as Umm Fattan. A man from the companions of Imam Ali ibn Abi Talib (as) came to her and greeted her, finding her distressed. He asked her: 'Why do I see you worried?' She replied: 'A female servant of mine passed away, and I buried her, but the earth rejected her twice.' The man went to the Commander of the Faithful (as) and informed him of this. Imam Ali ibn Abi Talib (as) said: 'Indeed, the earth accepts the Jew and the Christian, so why would it reject her unless she was being punished by Allah (swt), the Almighty and Majestic?' Imam Ali ibn Abi Talib (as) then said: 'If soil from the grave of a Muslim man were taken and scattered over her grave, the earth would settle.'" The man returned to Umm Fattan and informed her of this. She took soil from the grave of a Muslim man and scattered it over her servant's grave, and the earth accepted her. When he inquired about the servant's deeds, it was said: 'She had an intense love for men, and whenever she gave birth, she would throw her child into the oven.'"

"He is liable for one legal punishment for accusing her. As for his statement, 'I have committed adultery with you,' there is no legal punishment for that unless he testifies against himself four times for committing adultery before the Imam."

"None of you should intercede in the enforcement of a legal punishment (hadd) once it has reached the Imam, for the Imam has no authority to waive it through intercession. However, before it reaches the Imam, it is still under the control of those involved, so intercede in cases that have not yet reached the Imam, if you see signs of remorse. Intercede in matters that have not reached the Imam, as long as they do not involve a legal punishment, and if the one being interceded for shows repentance. Do not intercede in the right of any Muslim-or anyone else-except with their permission."

"Indeed, Allah (swt), Blessed and Exalted, has ruled differently regarding your blood than He (swt) has regarding your wealth. In matters of wealth, the ruling is that the burden of proof is upon the claimant, and the oath is upon the one against whom the claim is made. However, in matters of blood, the ruling is that the oath is upon the claimant, and the proof is upon the one against whom the claim is made, so that the blood of a Muslim is not unjustly nullified."

I asked Imam (as) about a child who steals. Imam (as) said: "If he is seven years old or younger, the punishment is lifted from him. But if he repeats the act after the age of seven, his fingertip is to be cut off or scraped until it bleeds. If he repeats it again, a part below his fingertip is to be cut off. If he steals again after that and has reached nine years of age, his hand is to be cut off. None of the prescribed punishments of Allah (swt), the Mighty and Majestic, are to be neglected."

"Imam Ali ibn Abi Talib (as) was asked about a mukatab (a slave who has a contract for freedom) who falsely accused a Muslim man. Imam (as) said: 'He is to be flogged with the punishment of a free man - eighty lashes - whether he has paid any part of his contract or not.' It was asked: 'What if he commits adultery while he is a mukatab and has not paid anything from his contract?' Imam (as) said: 'This is the right of Allah (swt), the Mighty and Majestic. Fifty lashes are waived from him, and he is to be flogged fifty lashes.'"

“Abu ‘Abd Allah (a.s.), has said, ‘In the matters of your blood (lives), Allah has judged differently from His judging in matters of your assets. In matters of your assets and belongings, He has judged by means of placing the establishment of testimony (burden of proof) on the plaintiff and oath on the defendant. In matters of your blood (lives), He has placed establishment of testimony (burden of proof) on the defendant, and oath on the plaintiff so that the blood (life) of a Muslim is not invalidated.’”

I asked Abu Abdullah (as) about a Muslim man who committed adultery with the bondwoman of his brother. What is his repentance? Imam (as) replied: "He should go to him, inform him of what he has done, and ask him to pardon him, and he must not repeat the act." I asked: "What if his brother does not pardon him?" Imam (as) said: "Then he will meet Allah (swt), the Mighty and Majestic, as an adulterer and a betrayer." I asked: "Will Hellfire be his destination?" Imam (as) replied: "The intercession of Muhammad (peace be upon him and his family) and our intercession encompasses your sins, O' Shia community. But do not return to such acts and do not rely on our intercession, for by Allah (swt), no one will attain our intercession if he commits this sin until he experiences the pain of punishment and witnesses the terror of Hell."
