hadith 603

7. Humayd ibn Ziyad has narrated from al-Hassan from Muhammad ibn Ziyad and Safwan from Rifa‘ah who has said the following

“Abu ‘Abd Allah (a.s.), has said that women in al-Khul‘ do not have the right for maintenance and housing.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ عَنْ مُحَمَّدِ بْنِ زِيَادٍ وَ صَفْوَانَ عَنْ رِفَاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ

الْمُخْتَلِعَةُ لَا سُكْنَى لَهَا وَ لَا نَفَقَةَ .

8. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ibn Ribat from Ishaq ibn ‘Ammar who has said the following

“I once asked abu al-Hassan (a.s.), about the divorced woman; where she completes her waiting period. He (the Imam) said, ‘She completes it in the house of her husband.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنِ ابْنِ رِبَاطٍ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي الْحَسَنِ ( عليه السلام ) قَالَ

سَأَلْتُهُ عَنِ الْمُطَلَّقَةِ أَيْنَ تَعْتَدُّ فَقَالَ فِي بَيْتِ زَوْجِهَا .

6. Humayd ibn Ziyad has narrated from ibn Sama‘ah from Muhammad ibn Ziyad from ‘Abd Allah ibn Sinan who has said the following

“Abu ‘Abd Allah (a.s.), has said, ‘Waiting period of a pregnant widow ends with the end of the longer of the two time periods.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ

الْحُبْلَى الْمُتَوَفَّى عَنْهَا زَوْجُهَا عِدَّتُهَا آخِرُ الْأَجَلَيْنِ .

4. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following

“Abu ‘Abd Allah (a.s.), has said, ‘One’s divorcing during his illness is not permissible, however, his marriage is permissible.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ

لَا يَجُوزُ طَلَاقُ الْمَرِيضِ وَ يَجُوزُ نِكَاحُهُ .

hadith 374

3. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad from Wuhayb ibn Hafs from abu Basir who has narrated the following

“About the case of a woman who dies and leaves behind her husband, abu Ja‘far (a.s.), has said, ‘One-fourth belongs to the woman and the rest belongs to the Imam.’”

3- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ عَنْ وُهَيْبِ بْنِ حَفْصٍ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام)

فِي رَجُلٍ تُوُفِّيَ وَتَرَكَ امْرَأَتَهُ فَقَالَ لِلْمَرْأَةِ الرُّبُعُ وَمَا بَقِيَ فَلِلإمَامِ‏.

12. Humayd ibn Ziyad has narrated from ibn Sama‘ah from Muhammad ibn Ziyad from Mu‘awiyah ibn ‘Ammar who has said the following

“I once heard abu ‘Abd Allah (a.s.), saying, ‘A divorced woman can perform al-Hajj if her husband agrees.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ مُعَاوِيَةَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ

سَمِعْتُهُ يَقُولُ الْمُطَلَّقَةُ تَحُجُّ فِي عِدَّتِهَا إِنْ طَابَتْ نَفْسُ زَوْجِهَا .

6. Humayd has narrated from al-Hassan from Ja‘far ibn Sama‘ah from Dawud ibn Sarhan who has said the following

“About the case of a woman in al-Khul‘ abu ‘Abd Allah (a.s.), has said, ‘Her waiting period is like the waiting period of a divorced woman. She must count her waiting period in her home and a woman of al-Khul‘ is like the woman in al-Mubarat (disavowing).”’

حُمَيْدٌ عَنِ الْحَسَنِ عَنْ جَعْفَرِ بْنِ سَمَاعَةَ عَنْ دَاوُدَ بْنِ سِرْحَانَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) فِي الْمُخْتَلِعَةِ قَالَ

عِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ وَ تَعْتَدُّ فِي بَيْتِهَا وَ الْمُخْتَلِعَةُ بِمَنْزِلَةِ الْمُبَارِئَةِ .

5. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a woman whose husband dies if she can perform al-Hajj and bear witness for rights. He (the Imam) said, ‘

Yes, she can do so.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ عَنِ ابْنِ بُكَيْرٍ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) فِي الْمُتَوَفَّى عَنْهَا زَوْجُهَا أَ تَحُجُّ وَ تَشْهَدُ الْحُقُوقَ قَالَ

نَعَمْ .

5. Humayd ibn Ziyad has narrated from ibn Sama‘ah from Muhammad ibn Ziyad from ‘Abd Allah ibn Sinan who has said the following

“Abu ‘Abd Allah (a.s.), has said that waiting period for a woman in al-Khul‘ is like that of a divorced woman and her al-Khul‘ is her divorce.’ He (the narrator) has said that he then asked if she receives any benefits. He (the Imam) said, ‘No, she does not receive any benefits.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ

عِدَّةُ الْمُخْتَلِعَةِ عِدَّةُ الْمُطَلَّقَةِ وَ خُلْعُهَا طَلَاقُهَا قَالَوَ سَأَلْتُهُ هَلْ تُمَتَّعُ بِشَيْ‏ءٍ قَالَ لَا .

8. Ali ibn Ibrahim has narrated from his father from ibn abu Najran from ‘Asem ibn Humayd from Muhammad ibn Qays who has narrated the following

“Abu Abu Ja‘far (a.s.), has said, ‘A woman inherits from the wergild of her husband and her husband inherits from the wergild of his wife as long as one of them does not kill the other partner.’”

8- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ

الْمَرْأَةُ تَرِثُ مِنْ دِيَةِ زَوْجِهَا وَيَرِثُ مِنْ دِيَتِهَا مَا لَمْ يَقْتُلْ أَحَدُهُمَا صَاحِبَهُ.

Hadith.4529 - Asim ibn Humayd narrated from Abu Basir, who said

I heard Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) say: "Whoever has a wife and does not provide her with clothing to cover her modesty and food to sustain her strength, it is the duty of the Imam to separate them."

4529 - وَ رَوَى عَاصِمُ بْنُ حُمَيْدٍ عَنْ أَبِي بَصِيرٍ قَالَ

سَمِعْتُ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ يَقُولُ: "مَنْ كَانَتْ عِنْدَهُ اِمْرَأَةٌ فَلَمْ يَكْسُهَا مَا يُوَارِي عَوْرَتَهَا وَ يُطْعِمْهَا مَا يُقِيمُ صُلْبَهَا كَانَ حَقّاً عَلَى اَلْإِمَامِ أَنْ يُفَرِّقَ بَيْنَهُمَا".

1. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from more than one person from Aban from abu Maryam who has said the

folio wing: “Abu Ja‘far (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘How can one of you hurt the woman whom he continues to embrace? 5 ”

1- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ غَيْرِ وَاحِدٍ عَنْ أَبَانٍ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ

قَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) أَيَضْرِبُ أَحَدُكُمُ الْمَرْأَةَ ثُمَّ يَظَلُّ مُعَانِقَهَا.

8. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from Ishaq ibn ‘Ammar from ’Isma‘il al-Ju‘fiy who has said the following

“About the case of a man who divorces his wife, abu Ja‘far (a.s.), has said, ‘He has the right to go back to her until she experiences Hayd (menses) for the third time after divorce.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ إِسْمَاعِيلَ الْجُعْفِيِّ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ فَقَالَ

هُوَ أَحَقُّ بِرَجْعَتِهَا مَا لَمْ تَقَعْ فِي الدَّمِ الثَّالِثِ .

3. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from Safwan ibn Yahya from Musa ibn Bakr from Zurarah from abu Ja'far (AS) who said

"One should not have sex with a female servant until she reaches nine years of age or ten years of age."

3- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ مُوسَى بْنِ بَكْرٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ

لا يُدْخَلْ بِالْجَارِيَةِ حَتَّى يَأْتِيَ لَهَا تِسْعُ سِنِينَ أَوْ عَشْرُ سِنِينَ.

hadith 374

7. A number of our people have narrated from Sahl ibn Ziyad from ibn abu Nasr from ‘Asem ibn Hamid from Muhammad ibn Qays who has said the following

“Abu Ja‘far (a.s.), has said, ‘A woman who is divorced and her husband has the right to go back to her, can beautify herself before her husband and he does not need to ask permission to go to her.’”

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ أَبِي نَصْرٍ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ

الْمُطَلَّقَةُ تَشَوَّفَتْ لِزَوْجِهَا مَا كَانَ لَهُ عَلَيْهَا رَجْعَةٌ وَ لَا يَسْتَأْذِنُ عَلَيْهَا .

3. Humayd ibn Ziyad has narrated from al-Hassan ibn Sama‘ah from Ahmad ibn al-Hassan al-Mithamiy from Aban ibn ‘Uthman from ‘Ubayd ibn Zurarah and abu al-‘Abbas who has said the following

“Abu ‘Abd Allah (a.s.), has said, ‘A man must not go to bed with a woman in a Wednesday night.’”

3- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ سَمَاعَةَ عَنْ أَحْمَدَ بْنِ الْحَسَنِ الْمِيثَمِيِّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ عُبَيْدِ بْنِ زُرَارَةَ وَأَبِي الْعَبَّاسِ قَالا

قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) لَيْسَ لِلرَّجُلِ أَنْ يَدْخُلَ بِامْرَأَةٍ لَيْلَةَ الأرْبِعَاءِ.

hadith 359

7. Safwan has narrated from ibn Bukayr from Zurarah who has said the foliowing: “I once heard abu Ja‘far (a.s.), saying

‘A woman divorced becomes stranger to him with the first drop of blood because of Hayd (menses) during the last Hayd (menses)-free period.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ صَفْوَانَ عَنِ ابْنِ مُسْكَانَ عَنْ زُرَارَةَ مِثْلَهُ .صَفْوَانُ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ

سَمِعْتُهُ يَقُولُ الْمُطَلَّقَةُ تَبِينُ عِنْدَ أَوَّلِ قَطْرَةٍ مِنَ الدَّمِ فِي الْقُرْءِ الْأَخِيرِ .

3. Flumayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from ‘Abd Allah ibn Jabalah and Ja‘far ibn Sama‘ah from Jamil from ’Isma‘il al-Ju‘fiy ’Isma‘il who has said the following

“Abu Ja‘far (a.s.), has said, ‘Divorce of a pregnant woman is one and when she gives birth to what is inside her, she becomes stranger to him.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ عَبْدِ اللَّهِ بْنِ جَبَلَةَ وَ جَعْفَرِ بْنِ سَمَاعَةَ عَنْ جَمِيلٍ عَنْ إِسْمَاعِيلَ الْجُعْفِيِّ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ

طَلَاقُ الْحُبْلَى وَاحِدَةٌ فَإِذَا وَضَعَتْ مَا فِي بَطْنِهَا فَقَدْ بَانَتْ .

7. Humayd has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following

“I once asked abu Ibrahim (a.s.), about the case of a woman whose husband dies; if she can go out of the house of her husband. He (the Imam) said, ‘She can go out of the house of her husband, travel for al-Hajj or move from one house to another house.’”

حميد، عن ابن سماعة، عن عبد الله بن جبلة، عن ابن بكير، عن عبيد بن زرارة، عن أبي عبد الله عليه السلام قال

سألته عن المتوفى عنها زوجها أتخرج من بيت زوجها؟ قال: تخرج من بيت زوجها وتحج وتنتقل من منزل إلى منزل.

4. Ali has narrated from his father from ibn abu Najran from ‘Asem ibn Hamid from Muhammad ibn Qays who has said the following

“Abu Ja‘far (a.s.), has said, ‘A woman divorced must complete her waiting period in her home and it is not proper for her to go out until her waiting period is complete. Her waiting period is three Hayd-( menses)-free periods or three months except if she experiences Hayd (menses).”’

عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ

الْمُطَلَّقَةُ تَعْتَدُّ فِي بَيْتِهَا وَ لَا يَنْبَغِي لَهَا أَنْ تَخْرُجَ حَتَّى تَنْقَضِيَ عِدَّتُهَا وَ عِدَّتُهَا ثَلَاثَةُ قُرُوءٍ أَوْ ثَلَاثَةُ أَشْهُرٍ إِلَّا أَنْ تَكُونَ تَحِيضُ .
