hadith 595
Hadith.5565 - Muhammad ibn Abi Umayr narrated from Hisham ibn Al-Hakam, who said
I asked Imam (as) about a man who designates his slave for emancipation after his death (mudabbar). Can he revoke this decision? Imam (as) said: "Yes, it is like a will."
5565 - وَ رَوَى مُحَمَّدُ بْنُ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ اَلْحَكَمِ قَالَ
سَأَلْتُهُ عَنِ اَلرَّجُلِ يُدَبِّرُ مَمْلُوكَهُ أَ لَهُ أَنْ يَرْجِعَ فِيهِ فَقَالَ "نَعَمْ هُوَ بِمَنْزِلَةِ اَلْوَصِيَّةِ".

2. Ahmad ibn Muhammad has narrated from Ali ibn al-Hakam from Muthanna’ al-Hannat from Ishaq ibn Yazid who has said the following
“Abu ‘Abd Allah (a.s.), has said, ‘It is of the rights of a Muslim on a Muslim to accept his invitation.’”
أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُثَنًّى الْحَنَّاطِ عَنْ إِسْحَاقَ بْنِ يَزِيدَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ
إِنَّ مِنْ حَقِّ الْمُسْلِمِ عَلَى الْمُسْلِمِ أَنْ يُجِيبَهُ إِذَا دَعَاهُ .

3. Ali ibn Ibrahim has narrated from his father and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from all from Ibn Abi ‘Umayr from Jamil ibn Darraj from Zakariya ibn Yahya al-Shu‘ayriy from al-Hakam ibn ‘Utaybah who has narrated the following
“Once we were with abu Ja‘far (a.s.). We were in a group waiting for him (the Imam) to come out. A woman came and asked, ‘Which one of you is abu Ja‘far?’ The people asked, ‘What for are you asking for him?’ She replied, ‘I want to ask him about an issue.’ They said, ‘This is the jurist of the people of Iraq. You can ask him your question.’ She said, ‘My husband has died and has left one thousand dirham as legacy. He owed me five hundred dirham as my mahr (dower) and my share of inheritance which I took from the legacy; but then a man came and said my husband owed him one thousand dirham and I testified in his favor.’ Al-Hakam has said, ‘I was counting it that abu Ja‘far (a.s.), came out and said, “Why is it that I see you move your fingers, O Hakam?” I replied, “This woman has mentioned that her husband has died. He has left one thousand dirham as legacy. He owed to her five hundred dirham as her dower. She took her dower and the share of her inheritance, but then a man came and said that her husband owed him one thousand dirham and she testified in his favor.’” Hakam has said, ‘By Allah I had not completed my words that he (the Imam) said, “She has confessed to give back one-third of what she has in her hand and she does not have anything as her share of inheritance.’” Hakam has said, ‘I had never seen, by Allah, anyone more intelligent than abu Ja‘far (a.s.).”’
3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ جَمِيعاً عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ زَكَرِيَّا بْنِ يَحْيَى الشَّعِيرِيِّ عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ قَالَ
كُنَّا عَلَى بَابِ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) وَنَحْنُ جَمَاعَةٌ نَنْتَظِرُ أَنْ يَخْرُجَ إِذْ جَاءَتِ امْرَأَةٌ فَقَالَتْ أَيُّكُمْ أَبُو جَعْفَرٍ فَقَالَ لَهَا الْقَوْمُ مَا تُرِيدِينَ مِنْهُ قَالَتْ أُرِيدُ أَنْ أَسْأَلَهُ عَنْ مَسْأَلَةٍ فَقَالُوا لَهَا هَذَا فَقِيهُ أَهْلِ الْعِرَاقِ فَسَلِيهِ فَقَالَتْ إِنَّ زَوْجِي مَاتَ وَتَرَكَ أَلْفَ دِرْهَمٍ وَكَانَ لِي عَلَيْهِ مِنْ صَدَاقِي خَمْسُمِائَةِ دِرْهَمٍ فَأَخَذْتُ صَدَاقِي وَأَخَذْتُ مِيرَاثِي ثُمَّ جَاءَ رَجُلٌ فَادَّعَى عَلَيْهِ أَلْفَ دِرْهَمٍ فَشَهِدْتُ لَهُ قَالَ الْحَكَمُ فَبَيْنَا أَنَا أَحْسُبُ إِذْ خَرَجَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) فَقَالَ مَا هَذَا الَّذِي أَرَاكَ تُحَرِّكُ بِهِ أَصَابِعَكَ يَا حَكَمُ فَقُلْتُ إِنَّ هَذِهِ الْمَرْأَةَ ذَكَرَتْ أَنَّ زَوْجَهَا مَاتَ وَتَرَكَ أَلْفَ دِرْهَمٍ وَكَانَ لَهَا عَلَيْهِ مِنْ صَدَاقِهَا خَمْسُمِائَةِ دِرْهَمٍ فَأَخَذَتْ صَدَاقَهَا وَأَخَذَتْ مِيرَاثَهَا ثُمَّ جَاءَ رَجُلٌ فَادَّعَى عَلَيْهِ أَلْفَ دِرْهَمٍ فَشَهِدَتْ لَهُ فَقَالَ الْحَكَمُ فَوَ اللهِ مَا أَتْمَمْتُ الْكَلامَ حَتَّى قَالَ أَقَرَّتْ بِثُلُثِ مَا فِي يَدَيْهَا وَلا مِيرَاثَ لَهَا قَالَ الْحَكَمُ فَمَا رَأَيْتُ وَاللهِ أَفْهَمَ مِنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَطُّ. قَالَ ابْنُ أَبِي عُمَيْرٍ وَتَفْسِيرُ ذَلِكَ أَنَّهُ لا مِيرَاثَ لَهَا حَتَّى تَقْضِيَ الدَّيْنَ وَإِنَّمَا تَرَكَ أَلْفَ دِرْهَمٍ وَعَلَيْهِ مِنَ الدَّيْنِ أَلْفٌ وَخَمْسُمِائَةِ دِرْهَمٍ لَهَا وَلِلرَّجُلِ فَلَهَا ثُلُثُ الألْفِ وَلِلرَّجُلِ ثُلُثَاهَا.

5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Aban who has narrated the following
“In the case of a will for which there is no witness except a woman, abu ‘Abd Allah (a.s.), accepted it (such witness) for one-fourth of the will according to her testimony.’”
5- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبَانٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام)
أَنَّهُ قَالَ فِي وَصِيَّةٍ لَمْ يَشْهَدْهَا إِلا امْرَأَةٌ فَأَجَازَ شَهَادَةَ الْمَرْأَةِ فِي الرُّبُعِ مِنَ الْوَصِيَّةِ بِحِسَابِ شَهَادَتِهَا.

2. It is narrated from the narrator of the previous Hadith from his father Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan from all from Ibn Abi ‘Umayr from Hisham ibn al-Hakam who has narrated the following
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who makes his slave a Mudabbar; if he can change such decision. He (the Imam) said, ‘Yes, he can do so because it is like the will.’”
2- عَنْهُ عَنْ أَبِيهِ وَمُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ جَمِيعاً عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ الْحَكَمِ قَالَ
سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يُدَبِّرُ مَمْلُوكَهُ أَلَهُ أَنْ يَرْجِعَ فِيهِ قَالَ نَعَمْ هُوَ بِمَنْزِلَةِ الْوَصِيَّةِ.

hadith 84
3. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has narrated the following
“Abu ‘Abd Allah (a.s.), has said that al-Mudabbar is from one-third of the legacy.’ He (the Imam) said, ‘One can change his will about one-third of his legacy regardless of whether one is ill or in good health.’”
3- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ
الْمُدَبَّرُ مِنَ الثُّلُثِ وَقَالَ لِلرَّجُلِ أَنْ يَرْجِعَ فِي ثُلُثِهِ إِنْ كَانَ أَوْصَى فِي صِحَّةٍ أَوْ مَرَضٍ.

hadith 101
2. Ahmad ibn Muhammad has narrated from Ali ibn al-Hakam from Ali ibn al-Nu’man from abu Ayyub from Muhammad ibn Muslim who has narrated the following
“I once heard abu ‘Abd Allah (a.s.), saying, ‘When a boy is about to die his will is permissible in favor of the relatives but not in favor of the strangers.’”
2- أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَلِيِّ بْنِ النُّعْمَانِ عَنْ أَبِي أَيُّوبَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ
سَمِعْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) يَقُولُ إِنَّ الْغُلامَ إِذَا حَضَرَهُ الْمَوْتُ فَأَوْصَى وَلَمْ يُدْرِكْ جَازَتْ وَصِيَّتُهُ لِذَوِي الأرْحَامِ وَلَمْ تَجُزْ لِلْغُرَبَاءِ.

Hadith.5449 - Ali ibn Al-Hakam narrated from Sayf ibn Umayrah from Manṣur ibn Hazim from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as), who said
"If a man appoints his brother as his executor while he is absent, he does not have the right to reject the will. This is because if he had been present and refused to accept it, the testator would have sought someone else."
5449 - وَ رَوَى عَلِيُّ بْنُ اَلْحَكَمِ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ مَنْصُورِ بْنِ حَازِمٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ
"إِذَا أَوْصَى اَلرَّجُلُ إِلَى أَخِيهِ وَ هُوَ غَائِبٌ فَلَيْسَ لَهُ أَنْ يَرُدَّ وَصِيَّتَهُ لِأَنَّهُ لَوْ كَانَ شَاهِداً فَأَبَى أَنْ يَقْبَلَهَا طَلَبَ غَيْرَهُ".

hadith 483
Hadith.5453 - Ali ibn Al-Hakam narrated from Dawud ibn Al-Nuʿman from Abu Ayyub from Muhammad ibn Muslim, who said
I heard Abu Abdullah (as) say: "If a boy is on his deathbed and makes a will before reaching maturity, his will is valid if it is for his close relatives, but it is not valid for strangers."
5453 - وَ رَوَى عَلِيُّ بْنُ اَلْحَكَمِ عَنْ دَاوُدَ بْنِ اَلنُّعْمَانِ عَنْ أَبِي أَيُّوبَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ
سَمِعْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ يَقُولُ : "إِنَّ اَلْغُلاَمَ إِذَا حَضَرَهُ اَلْمَوْتُ فَأَوْصَى وَ لَمْ يُدْرِكْ جَازَتْ وَصِيَّتُهُ لِذَوِي اَلْأَرْحَامِ وَ لَمْ تَجُزْ لِلْغُرَبَاءِ".

6. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hisham ibn al-Hakam who has narrated the following
“About the meaning of the words of Allah, most Majestic, most Glorious, ’. . .or two from people other than your people,’ (5:106) abu ‘Abd Allah (a.s.), has said, ‘This applies when a man is away from his land where Muslims are not found, then appointing non-Muslims as witness to a will is permissible.’”
6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ الْحَكَمِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي قَوْلِ اللهِ عَزَّ وَجَلَّ أَوْ آخَرانِ مِنْ غَيْرِكُمْ قَالَ
إِذَا كَانَ الرَّجُلُ فِي أَرْضِ غُرْبَةٍ لا يُوجَدُ فِيهَا مُسْلِمٌ جَازَتْ شَهَادَةُ مَنْ لَيْسَ بِمُسْلِمٍ عَلَى الْوَصِيَّةِ.

4. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has narrated the following
“About the case of a man who when about to die sets free his slave and makes a will but the total is more than one-third of his legacy, abu ‘Abd Allah (a.s.), has said, ‘It is executed about the setting free of the slave and the deficit falls on the rest of the will.’”
4- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ
سَأَلْتُهُ عَنْ رَجُلٍ حَضَرَهُ الْمَوْتُ فَأَعْتَقَ مَمْلُوكَهُ وَأَوْصَى بِوَصِيَّةٍ فَكَانَ أَكْثَرَ مِنَ الثُّلُثِ قَالَ يُمْضَى عِتْقُ الْغُلامِ وَيَكُونُ النُّقْصَانُ فِيمَا بَقِيَ.

3. Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Ali ibn al-Hakam from Sayf ibn ’Amirah from Mansur ibn Hazim who has narrated the following
“Abu ‘Abd Allah (a.s.), has said, ‘If a man makes a will in which he appoints his brother as the executor when he is absent, he cannot refuse the appointment for if he was present and refused, another person could have been appointed as the executor.’”
3- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ مَنْصُورِ بْنِ حَازِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ
إِذَا أَوْصَى الرَّجُلُ إِلَى أَخِيهِ وَهُوَ غَائِبٌ فَلَيْسَ لَهُ أَنْ يَرُدَّ عَلَيْهِ وَصِيَّتَهُ لأنَّهُ لَوْ كَانَ شَاهِداً فَأَبَى أَنْ يَقْبَلَهَا طَلَبَ غَيْرَهُ.

3. Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan and Ali ibn Ibrahim has narrated from his father from all from Ibn Abi ‘Umayr from Fiisham ibn al-Hakam who has narrated the following
“About the meaning of the words of Allah, most Majestic, most Glorious, ‘. . . and two people from others who are not of your people’ abu ‘Abd Allah (a.s.), has said, ‘This applies when he is in a place where Muslims are not available, then asking a non-Muslim to bear witness to a will is permissible.’”
3- مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ الْحَكَمِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي قَوْلِ اللهِ تَبَارَكَ وَتَعَالَى أَوْ آخَرانِ مِنْ غَيْرِكُمْ قَالَ
إِذَا كَانَ الرَّجُلُ فِي بَلَدٍ لَيْسَ فِيهِ مُسْلِمٌ جَازَتْ شَهَادَةُ مَنْ لَيْسَ بِمُسْلِمٍ عَلَى الْوَصِيَّةِ.

hadith 605
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Ali ibn al-Hakam from Sayf ibn ‘ Amirah from ‘ Amr ibn Shamir from Jabir from abu Ja’far (a.s.) who has said the following
“Of the rights of the believer on his believing brother (in belief) is to satisfy his hunger, provide covering for his privacy, facilitate his hardships and pay off his debts. When he dies, look after his family and children.”
1ـ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ عَمْرِو بْنِ شِمْرٍ عَنْ جَابِرٍ عَنْ أَبِي جَعْفَرٍ (عَلَيهِ السَّلام) قَالَ
مِنْ حَقِّ الْمُؤْمِنِ عَلَى أَخِيهِ الْمُؤْمِنِ أَنْ يُشْبِعَ جَوْعَتَهُ وَيُوَارِيَ عَوْرَتَهُ وَيُفَرِّجَ عَنْهُ كُرْبَتَهُ وَيَقْضِيَ دَيْنَهُ فَإِذَا مَاتَ خَلَفَهُ فِي أَهْلِهِ وَوُلْدِهِ.

hadith 51
2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Ali ibn al-Hakam from m al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has narrated the following
“This is about the case of a man who has made a will to spend his asset in the way of Allah. One of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ‘You must give it to the designated beneficiary even if he is a Christian or a Jew; Allah, most Blessed, most High, says, “Whoever intentionally changes the will of a deceased person, he has committed a sin. Allah is All- hearing and All-knowing.” (2:181)’”
2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام)
فِي رَجُلٍ أَوْصَى بِمَالِهِ فِي سَبِيلِ اللهِ قَالَ أَعْطِ لِمَنْ أَوْصَى لَهُ بِهِ وَإِنْ كَانَ يَهُودِيّاً أَوْ نَصْرَانِيّاً إِنَّ اللهَ تَبَارَكَ وَتَعَالَى يَقُولُ فَمَنْ بَدَّلَهُ بَعْدَ ما سَمِعَهُ فَإِنَّما إِثْمُهُ عَلَى الَّذِينَ يُبَدِّلُونَهُ.

Hadith.5566 - Ali ibn Al-Hakam narrated from Ziyad ibn Abi Al-Hallal, who said
I asked Abu Abdullah (as), whether the Messenger of Allah (swt), peace and blessings be upon him and his family, had appointed Al-Hasan (as) and Al-Hussain (as), peace be upon them both, along with the Commander of the Faithful (as), peace be upon him, in his will. Imam (as) replied: "Yes." I asked: "Even though they were at that young age?" Imam (as) said: "Yes, and this would not be for anyone else under the age of five."
5566 - وَ رَوَى عَلِيُّ بْنُ اَلْحَكَمِ عَنْ زِيَادِ بْنِ أَبِي اَلْحَلاَّلِ قَالَ
سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَسُولِ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَ آلِهِ هَلْ أَوْصَى إِلَى اَلْحَسَنِ وَ اَلْحُسَيْنِ عَلَيْهِمَا اَلسَّلاَمُ مَعَ أَمِيرِ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ قَالَ "نَعَمْ" قُلْتُ وَ هُمَا فِي ذَلِكَ اَلسِّنِّ قَالَ "نَعَمْ وَ لاَ يَكُونُ لِسِوَاهُمَا فِي أَقَلَّ مِنْ خَمْسِ سِنِينَ".

hadith 70
14. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Uthaman who has said the following
“Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah asked for a sahifah (a book) and he (the Messenger of Allah) wanted to prohibit the use of certain names to use. He (the Messenger of Allah) passed away but he (the Messenger of Allah) did not mention them. Of such names are al- Hakam and Hakim, Khalid and Malik. He (the Imam) said that such names are six or seven and it is not permissible to use them.’”
عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ
إِنَّ رَسُولَ اللَّهِ ( صلى الله عليه وآله ) دَعَا بِصَحِيفَةٍ حِينَ حَضَرَهُ الْمَوْتُ يُرِيدُ أَنْ يَنْهَى عَنْ أَسْمَاءٍ يُتَسَمَّى بِهَا فَقُبِضَ وَ لَمْ يُسَمِّهَا مِنْهَا الْحَكَمُ وَ حَكِيمٌ وَ خَالِدٌ وَ مَالِكٌ وَ ذَكَرَ أَنَّهَا سِتَّةٌ أَوْ سَبْعَةٌ مِمَّا لَا يَجُوزُ أَنْ يُتَسَمَّى بِهَا .

hadith 371
2. My father, may Allah grant him mercy, said: We were told by Sa’d bin Abdullah, from Ahmad bin Muhammed, from Ali bin Hakam, from Aban al-Ahmar, from Abdullah bin Sinan, that he said
I asked Abu Abdillah, peace be upon him, of a woman who bequeathed with her third, that the debt of the son of her brother is cleared with it, and that a part is for such-a-male and such-a-female, and I did not know (how to deal with) that, so we approached Ibn Abi Layla. He said: So what did he say to you? I said: He said: There is nothing to them. So he said: He has lied, by Allah. To them is a tenth of the third.
أبي - رحمه الله - قال: حدثنا سعد بن عبد الله، عن أحمد بن محمد، عن علي بن الحكم، عن أبان الأحمر، عن عبد الله بن سنان قال
سألت أبا عبد الله عليه السلام عن امرأة أوصت بثلثها يقضي به دين ابن أخيها وجزء لفلان وفلانة فلم أعرف ذلك، فقدمنا إلى ابن أبي ليلى. قال: فما قال لك؟ قلت: قال: ليس لهما شئ. فقال: كذب والله، لهما العشر من الثلث.

hadith 619
15. A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from abu al-Maghra’ from Abu ‘Abdillah (a.s.) who has said the following
“The Muslim is the brother of the Muslim (in belief). He does not do injustice to him, does not betray him, and does not violate his trust. It is worthwhile for the Muslims to be assiduous in maintaining good relations with each other, be kind to each other, assist the needy ones financially and be compassionate toward each other so that they can be as Allah, the Most Majestic, the Most Holy, has commanded them to be, ‘Compassionate toward each other, ’(48:29) kind to one another and feel sad for their absence from them. You should be just as the group of Ansar (the supporters) was in the lifetime of the Messenger of Allah (a.s.) as mentioned in (48:29).’”
15ـ عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبِي الْمَغْرَاءِ عَنْ أَبِي عَبْدِ الله (عَلَيهِ السَّلام) قَالَ
الْمُسْلِمُ أَخُو الْمُسْلِمِ لا يَظْلِمُهُ وَلا يَخْذُلُهُ وَلا يَخُونُهُ وَيَحِقُّ عَلَى الْمُسْلِمِينَ الإجْتِهَادُ فِي التَّوَاصُلِ وَالتَّعَاوُنُ عَلَى التَّعَاطُفِ وَالْمُوَاسَاةُ لأهْلِ الْحَاجَةِ وَتَعَاطُفُ بَعْضِهِمْ عَلَى بَعْضٍ حَتَّى تَكُونُوا كَمَا أَمَرَكُمُ الله عَزَّ وَجَلَّ رُحَمَاءَ بَيْنَكُمْ مُتَرَاحِمِينَ مُغْتَمِّينَ لِمَا غَابَ عَنْكُمْ مِنْ أَمْرِهِمْ عَلَى مَا مَضَى عَلَيْهِ مَعْشَرُ الأنْصَارِ عَلَى عَهْدِ رَسُولِ الله (صَلَّى اللهُ عَلَيْهِ وآلِه).

hadith 1072
9. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-Kahiliy from Mansur ibn Hazim who has said the following
“This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a house which a certain people divided, each one took a piece, built and left in between a courtyard with the driveway on it. A man came and bought the share of someone among them; if he can do so. He (the Imam) said, ‘Yes, he can do so but he must close his door and open a door to a driveway or climb down from the top of the house and close its door. When the owner of the driveway decides to sell, they have the right more than others, otherwise, it is the pathway through which he comes to set on that door.’”
9- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْكَاهِلِيِّ عَنْ مَنْصُورِ بْنِ حَازِمٍ قَالَ
قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) دَارٌ بَيْنَ قَوْمٍ اقْتَسَمُوهَا فَأَخَذَ كُلُّ وَاحِدٍ مِنْهُمْ قِطْعَةً وَبَنَاهَا وَتَرَكُوا بَيْنَهُمْ سَاحَةً فِيهَا مَمَرُّهُمْ فَجَاءَ رَجُلٌ فَاشْتَرَى نَصِيبَ بَعْضِهِمْ أَلَهُ ذَلِكَ قَالَ نَعَمْ وَلَكِنْ يَسُدُّ بَابَهُ وَيَفْتَحُ بَاباً إِلَى الطَّرِيقِ أَوْ يَنْزِلُ مِنْ فَوْقِ الْبَيْتِ وَيَسُدُّ بَابَهُ فَإِنْ أَرَادَ صَاحِبُ الطَّرِيقِ بَيْعَهُ فَإِنَّهُمْ أَحَقُّ بِهِ وَإِلا فَهُوَ طَرِيقُهُ يَجِي‏ءُ حَتَّى يَجْلِسَ عَلَى ذَلِكَ الْبَابِ.
