Hadith.3556 - Commander of the Faithful Imam Ali ibn Abi Talib (as) said: "If the father embraces Islam, he leads his child to Islam. When the child reaches maturity, he is invited to accept Islam; if he refuses, he is to be killed. However, if the child accepts Islam, they do not bring their parents into it, and there will be no inheritance between them."

“Abu ‘Abd Allah (a.s.), has said, ‘If one becomes a Muslim before the legacy is distributed, he receives his share but if one becomes a Muslim after the legacy is distributed then there is nothing for him.’”

“One of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ‘If one becomes a Muslim before the legacy is distributed the legacy belongs to him. If one becomes a Muslim after the legacy is distributed there is no legacy for him. If one is set free before the legacy is distributed it belongs to him but if one is set free after the legacy is distributed then there is no legacy for him.’ About the case of a woman he (the Imam) said, ‘If she becomes a Muslim before the legacy is distributed she receives her share of the legacy.’”

I asked Abu Abdullah (as) about a Christian man who accepted Islam and then reverted to Christianity and died. Imam (as) said: "His inheritance goes to his Christian children." I then asked about a Muslim who converted to Christianity and then died. Imam (as) said: "His inheritance goes to his Muslim children."

“’Amir al-Mu’minin (a.s.), has said, ’If a Dhimmiy (taxpayer) becomes a Muslim when his father is living who has children besides him, then the father dies, the Muslim inherits all of his legacy and his other children and wife do not inherit anything with a Muslim.’”

I asked Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) about a Muslim man who died and had a Christian mother, along with a Muslim wife and Muslim children. Imam (as) said: "If his mother accepts Islam before the inheritance is divided, she is given one-sixth." I asked: "What if he has no wife, no children, and no heir entitled to a share in the Book from among the Muslims, and his mother is Christian, and his relatives are Christians who would have a share in the Book if they were Muslim - who inherits his wealth?" Imam (as) said: "If his mother embraces Islam, then all of his inheritance belongs to her. But if his mother does not embrace Islam and some of his relatives who have a rightful share in the Book accept Islam, the inheritance goes to them. If none of his relatives become Muslim, then his inheritance belongs to the Imam."

I asked Imam (as) about a Christian man who died, leaving behind a Muslim nephew (son of his brother) and a Muslim niece (daughter of his sister), while his own children and wife were Christians. Imam (as) said: "I see that the Muslim nephew should be given two-thirds of what he left behind, and the Muslim niece should be given one-third of what he left behind, provided he does not have young children. However, if he has young children, then the two heirs must provide for the children from what they inherited from their father until the children reach maturity." It was asked: "How should they provide for the children?" Imam (as) replied: "The heir of the two-thirds share must cover two-thirds of the expenses, and the heir of the one-third share must cover one-third of the expenses. Once the children mature, the heirs are no longer responsible for their expenses." It was then asked: "What if his children embrace Islam while they are still young?" Imam (as) said: "In that case, what their father left behind should be handed over to the Imam until they reach maturity. If they remain steadfast in Islam upon reaching maturity, the Imam will give them their inheritance. But if they do not remain in Islam upon maturity, the Imam will return the inheritance to the Muslim nephew and niece, giving the nephew two-thirds of what was left and the niece one-third."

“I once asked abu ‘ Abd Allah (a.s.), about the case of a Christian man who has died. The son of his brother is a Muslim and a son of his sister is a Muslim. The Christian man has children and a Christian wife. He (the Imam) said, ’Two-thirds of his legacy must be given to the son of his brother. One-third must be given to the son of his sister if he does not have any children who are small. However, if he has small children, then the heirs must pay for the maintenance of the small children from the legacy their father has left behind until they become mature.’ It then was asked from him (the Imam), ‘How must the two spend?’ He (the Imam) said, ‘The one who has received two- thirds must pay two-thirds of the maintenance and the one who has received one-third must pay one- third of maintenance until they become mature at which time they can discontinue payment for them.’ It then was asked, ‘What happens if the children become Muslims when they are small?’ He (the Imam) said, ‘Whatever their father has left behind must be given to the Imam until they become mature. If they remain Muslims the Imam gives their legacy to them. However, if they did not remain Muslims when they become mature, the Imam gives the legacy to the son of his brother and the son of his sister who are Muslims. Two-thirds of what is left is given to the son of his brother and one-third of what is left to the son of his sister.’”
